(San Francisco, CA)—The 5th Circuit Court of Appeals today upheld a lower court ruling that had declared the DACA rule unlawful. However, the 5th Circuit limited its ruling to Texas and paused the ruling overall pending appeal.
For now this decision does not change who can access DACA. In its decision, the 5th Circuit also limited its ruling to Texas, stating that in Texas DACA recipients would not be able to access work permits - but this part of the ruling is also on hold.
For now, eligible DACA recipients can and should continue to renew their DACA until something changes.
Regardless of what the future holds for the program, there are alternative ways DACA recipients can ensure a continuous income. We encourage beneficiaries of the program to visit our resource page on these alternatives to find more information and resources to act on this now.
The ILRC will continue to support DACA recipients as the Trump administration begins on Jan. 20 and beyond.
