With recent news highlighting the instances of racial profiling and warrantless arrests of immigrants, practitioners should consider this additional tool to challenge the government’s use of illegally obtained evidence in immigration court.
This webinar provides an overview of the law in support of motions to suppress; cover the burdens of proof and/or persuasion in a motion to suppress proceeding; and address special problems that arise in suppression cases, including client preparation for ICE interviews and in-court testimony. It also covers procedural issues from handling the master calendar hearing, requesting an evidentiary hearing, and seeking other immigration relief in the context of motions to suppress.

Dan’s work included combating immigration provider fraud, conducting know your rights presentations, providing technical assistance to pro bono attorneys who are handling cases in the federal courts of appeals, and serving as the ILRC’s Attorney of the Day. He is also the co-author of ILRC's publications, Asylum and Related Immigration Protections and Motions to Suppress. Before joining the ILRC, Dan represented clients as a staff attorney at the California Rural Legal Assistance Foundation in Sacramento, worked as a clinical instructor at the UC Davis School of Law Immigration Law Clinic, and served as a staff attorney for the United States Court of Appeals for the Ninth Circuit.

Rosy’s San Francisco law practice is focused exclusively on immigration law-family and marriage-based visas, adjustment of status, citizenship, removal and deportation defense, and federal immigration appeals. She serves as a coordinator of the AILA Raids Response Team, responding to large-scale raids conducted by the Immigration and Customs Enforcement (ICE). She is currently working with the ACLU and the San Francisco law firm, Morrison and Foerster, to represent a group of people who worked at the El Balazo Restaurant when it was raided by ICE on May 2, 2008. Motions to suppress have been filed and the hearings are currently ongoing. Rosy is a graduate of the University of California, Berkeley Law School (Boalt Hall).

Richard has been an Immigration Counsel at Legal Aid since September 2007. He provides advice on all aspects of immigration law, including naturalization, legal permanent residency, family petitions, U-visas, petitions under the Violence Against Women Act, special immigrant juvenile status, immigrant fraud protection, deportation defense, employment petitions, asylum, temporary protected status and similar matters.
